ANY PERSON, HOMEOWNER, REQUESTOR, or CONSUMER (ALL OF WHICH ARE REFERRED TO HEREIN AS "CONSUMER") THAT SUBMITS A PROJECT OR CONTRACT (REFERRED TO HEREIN AS A "PROJECT") TO MyHomeAngels.com FOR THE PURPOSE OF SEEKING BIDS FROM OTHER CONTRACTORS TO PERORM WORK ON THE PROJECT HEREBY AGREES TO THE FOLLOWING TERMS AND CONDITIONS:
Consumer understands that MyHomeAngels.com will use reasonable efforts to identify and introduce the Contractor, Sub-Contractor, and Home Service Professional ("Service Provider") to perform services for the Consumer on the Project. Consumer agrees to provide MyHomeAngels.com with such information concerning the Project as is reasonably necessary to assist MyHomeAngels.com in referring a Service Provider, including, for example, bid instructions, timelines, project specifications and the like.
Consumer agrees to indemnify MyHomeAngels.com, its officers, directors, employees and agents and to hold such persons harmless against any loss, expense, damage or liability (including reasonable attorneys' fees and costs) arising out of or based upon any contract that Consumer may enter into with a Service Provider. This obligation will survive termination of MyHomeAngels.com obligations hereunder.
MyHomeAngels.com has not made, and will not have the right to make any commitment or commitments on behalf of the Consumer or Service Provider. The Consumer shall negotiate all terms of any agreement between a Service Provider and them the Consumer. It is understood and agreed that MyHomeAngels.com is not a promisor or guarantor of any Service Providers qualifications.
Consumer shall make an independent determination of a Service Providers qualifications to perform work on the Project and shall hold MyHomeAngels.com harmless from any failure of a Service Provider to meet certain qualifications. MyHomeAngels.com shall have no liability of any kind to the consumer arising out of any contract or relationship between Consumer and Service Provider.
Eligible Subscribers
By accepting these terms, you confirm that you are 18 years of age or older, are capable of entering into a binding agreement, and that you will accurately complete any consumer information submitted to us.
General Disclaimer
In using MyHomeAngels.com’s service, you acknowledge that MyHomeAngels.com is not acting as your general contractor, agent, or advisor. Therefore, it is your sole responsibility to select a contractor and to negotiate the terms for any work performed. You may want to consult with appropriate expert advisors to assist in your home improvements, including a lawyer regarding contracts, permits, and other necessary job documentation and an insurance professional regarding the service provider's and your own insurance coverage requirements. Any information obtained from MyHomeAngels.com, our Ask Our Expert, and it's affiliates should be used at the sole discretion of the user. MyHomeAngels.com does not assume responsiblity for any liability resulting from information obtained from MyHomeAngels.com, our Ask Our Expert, and it's affiliates
MyHomeAngels.com does not:
(i) recommend or endorse any specific service provider
(ii) provide advice on a service provider to choose, or
(iii) screen any individual service provider's personal credit or legal standing.
Use of Account; Privacy
Use of Account; In order to protect you and others, you and other users of your account must comply with all applicable laws and regulations when using MyHomeAngels.com’s service and must not use our service to impersonate or harass any other person. MyHomeAngels.com recognizes that you have legitimate concerns about privacy. By accepting this Agreement, you expressly consent to uses and disclosures of your personal information as described in MyHomeAngels.com current privacy policy, which is available at: http:www.MyHomeAngels.com/
You are not permitted to reproduce, distribute, transmit, publish, or commercially exploit any information provided by MyHomeAngels.com without the appropriate permission of the copyright owner. This prohibition precludes emailing, faxing, posting to any bulletin board, storage in a database accessible to persons other than yourself, or otherwise making information available electronically or in any other form.
The consumer hereby acknowledges that he/it shall receive information, which is covered and has been obtained under the consent of MyHomeAngels.com’s Privacy Statement. The Service Provider agrees that he/it will not transfer, assign, or pass on to any other contractor or service party the buyers or potential buyers contact information. Buyers or potential buyers contact information is for the exclusive use of the Service Provider who receives this contact information.
By submitting a project and information online through MyHomeAngels.com, you agree to the terms set forth in this agreement.
Service Providers Terms of Use
The following Terms and Conditions will apply to all Service Providers who have submitted company information to MyHomeAngels.com with the intent of being listed in MyHomeAngels.com ’s directory or participating in MyHomeAngels.com ’s lead referral service or both. Service Providers agree to be bound by all the Terms and Conditions set forth below.
Insurance Requirements
We require all service providers to carry insurance, as required by state law. Failure of a Service Provider to carry adequate insurance may result in the termination and exclusion of the Service Provider from the Referral Service’s network of providers. All Service Providers must supply proof of state required insurance upon request.
Extra Screening
Service Providers may periodically be checked through third party entities. Such Third Party entities may include but not be limited to credit bureaus, better business bureaus, and other screening bureaus that may request proprietary information about the operation and worthiness of a Service Provider. Any unsatisfactory reports obtained from a third party entity may result in exclusion and/or termination of the Service Provider from the Referral Services network of providers.
Disclosure
Service Providers are not entitled to exclusive or proprietary information that the Referral Service may have access to or hold in its possession. Furthermore, Service Providers must not divulge or disclose any such proprietary or confidential information about the Referral Service to any other Referral Service or anyone else without first obtaining a release to do so from the Referral Service. Such confidential information shall include but not be limited to information involving contacts and any and all information about buyers and potential buyers contact information
Termination
MyHomeAngels.com retains sole discretion over all matters involving which Service Providers will be included in its online contractor directory and it leads program, and may revoke a Service Provider's inclusion at any time based on reasonable circumstances.
Charges and Rates
MyHomeAngels.com charges fees for matching buyers and potential buyers with approved Service Providers and advertising on it's site and within the network of referral sites. All Service Providers are required to pay the agreed charges. The corresponding lead charges will appear on each lead sent to the Service Provider, and which amount will be charged toService Provider's account upon acceptance of lead. MyHomeAngels.com charges monthly and/or yearly fees for priority placement in the directory. These monthly fees are non-refundable. These fees are subject to change.
Indemnity
Service Providers agree to indemnify and hold MyHomeAngels.com subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement. Service Providers and the Referral Service are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship exists or will be implied between the aforementioned parties.
Applicable Law
These Terms and Conditions are governed by the laws and statutes of the State of Florida not withstanding the residency and or location of any party who wish to file suit against MyHomeAngels.com. Subscribers agree to submit to jurisdiction in Florida and that any claim arising under these Terms and Conditions will be brought solely in a court in Broward County, Florida.
